Loudoun County Property Division Lawyer

Most people going through a divorce assume the fight is over percentages. It usually is not. The outcome is decided earlier, when each asset gets classified as separate, marital, or partly both, because only the marital portion is ever divided.

That classification work rests on documentation rather than argument, and it is considerably harder to do well after positions have hardened. A premarital down payment, an inheritance that passed through a joint account, a pension that started accruing before the wedding: each of those is either provable or it is not, and the records are what decide it.

Marquis Law Group handles property division for clients throughout Loudoun County, including Leesburg, Ashburn, Sterling, and Purcellville. Call (703) 777-6161.

Equitable Does Not Mean Equal

Virginia divides marital property under equitable distribution per Virginia Code 20-107.3, not community property. There is no automatic 50/50 split. The court classifies everything, then divides the marital estate in the proportion it considers fair after weighing statutory factors, including each spouse’s monetary and nonmonetary contributions, the length of the marriage, the circumstances that led to the divorce, and the tax consequences of the division.

Many Virginia cases resolve near an even split. That is a pattern, not an entitlement, and a case with unusual facts can land well away from it.

For the fuller framework, see our guide on whether Virginia is a community property state. This page covers what the work actually involves.

The Assets That Cause Disputes in Loudoun County

Property division here looks different from most of the country, because of who lives here.

Federal civilian retirement. FERS and CSRS annuities, the Thrift Savings Plan, and survivor benefit elections each divide under their own procedures. TSP requires its own qualifying retirement benefits court order rather than a standard QDRO, and an order drafted without regard to the plan’s requirements can be rejected by the administrator after your divorce is final.

Military retired pay. Division follows the federal Uniformed Services Former Spouses’ Protection Act, and the order must satisfy federal requirements to be accepted by the Defense Finance and Accounting Service. Survivor Benefit Plan elections are a separate decision with long-term consequences that are difficult to revisit later.

Government contractor compensation. Stock options, restricted stock units, and deferred compensation are common in this market and rarely simple. Vesting schedules determine how much was earned during the marriage, and awards granted during the marriage that vest afterward are frequently part marital and part separate.

Security clearance considerations. Financial disputes, unpaid obligations, and the disclosure requirements that accompany a divorce can intersect with clearance holding. Consider this deliberately rather than discovering it during a reinvestigation.

Closely held businesses and professional practices. A business built during the marriage is generally marital, and valuing it usually requires an expert. Goodwill, whether personal or enterprise, is often the contested piece.

Each of these divides correctly only with an order drafted to the specific plan or asset. Generic language is where the expensive mistakes live.

The Marital Home

In Loudoun County, the home is often the largest single asset, and its equity can exceed the retirement accounts.

There is no default outcome. Common resolutions include one spouse buying out the other’s interest, refinancing to remove one spouse from the mortgage, selling and dividing the proceeds, or a deferred sale that keeps children in place through a school year or until a defined event.

Two issues come up repeatedly. Being awarded the house does not remove you from the mortgage, so you usually need a refinance, which depends on your ability to qualify. And where separate funds contributed to the purchase, a premarital down payment or a gift from family, tracing those funds can meaningfully change how the equity is allocated.

If one spouse has moved out, see whether a spouse who leaves the marital home can return.

Retirement and the 50 Percent Ceiling

Under Virginia Code 20-107.3(G), a court may award a percentage of the marital share of a pension, profit sharing plan, deferred compensation plan, or retirement benefit, whether vested or not. That award cannot exceed 50 percent of the marital share of the benefits actually received.

The ceiling applies to the marital share, not the account balance. The statute defines marital share as the portion earned during the marriage and before the parties’ last separation. So an account worth $400,000 of which $150,000 accrued during the marriage carries a maximum award of $75,000.

Two consequences worth planning around. Your separation date directly determines the size of the marital share, making it a financial issue rather than a technicality. And a Qualified Domestic Relations Order is required to move funds out of an employer plan without triggering taxes and penalties.

Separate Property and Why the Records Decide It

Separate property includes what you owned before the marriage, and anything received by gift from a third party, inheritance, bequest, or descent. It also includes property acquired in exchange for separate property.

It stops being protected when it is no longer identifiable. Separate funds deposited into a joint account, a premarital home retitled into both names, or an inheritance used to fund a jointly owned purchase all create a presumption that the property became marital.

That presumption can be overcome by tracing, which means proving through records where the funds originated and following them forward. Tracing works when the documentation exists. Bank statements, closing documents, account histories, and gift or estate records are the evidence, and the spouse asserting the separate claim carries the burden of proof.

This is where early involvement matters most. Records from ten or fifteen years ago are obtainable, but not indefinitely or quickly.

Hidden Assets and Dissipation

Where one spouse controlled the finances, the first task is often establishing what actually exists. Discovery tools include interrogatories, requests for production, subpoenas to financial institutions and employers, and depositions. In appropriate cases, a forensic accountant can trace transfers and identify undisclosed accounts or income.

Dissipation is the related issue. Where a spouse spends, transfers, or conceals marital assets in anticipation of divorce or for a purpose unrelated to the marriage, the court can account for it in the distribution, effectively charging that spouse with the amount. Typical patterns include large unexplained withdrawals, transfers to family members, and sudden spending in the months before a filing.

As of July 1, 2026, a spouse can file for divorce from bed and board immediately upon separation under Virginia Code 20-95, which opens access to temporary orders including orders preventing a spouse from selling or dissipating marital assets while the case proceeds. That is a meaningful tool if you are concerned about assets disappearing.

Property Division Happens in Circuit Court

It’s worth knowing if you already have a family court case. In Virginia, the Circuit Court decides equitable distribution; for you, that’s the Loudoun County Circuit Court in Leesburg. Juvenile and Domestic Relations District Court handles custody, visitation, and support, but it does not divide marital property.

So a parent with an existing JDR support or custody order still needs a Circuit Court proceeding to divide assets. The two tracks can run at the same time, and coordinating them matters.

You Can Decide This Yourself

A negotiated separation agreement almost always produces a better result than litigation, and property division in a ratified agreement is generally final.

It also allows trades a court cannot make. Keeping the house in exchange for a smaller share of retirement, or accepting less property in exchange for a support structure that works better for both parties, are outcomes available in negotiation and not in a courtroom. Where the disagreement is narrow, collaborative divorce or mediation may resolve it faster and for considerably less.

Frequently Asked Questions

No. Virginia uses equitable distribution under Virginia Code 20-107.3, which means fair rather than automatically equal. Courts weigh statutory factors and often land near an even split, but they are not required to.

Not more than half of the marital share. Virginia Code 20-107.3(G) caps the award at 50 percent of the portion earned during the marriage and before your last separation. FERS, CSRS, and TSP each require orders drafted to their specific requirements.

A business built during the marriage is generally marital property and typically requires a valuation by a qualified expert. Courts rarely order co-ownership after divorce. More common outcomes include a buyout, an offsetting award of other assets, or, in some cases, a sale.

Discovery exists for this. Subpoenas to banks and employers, document production, depositions, and, where warranted, a forensic accountant can establish what exists. Concealment also damages that spouse’s credibility on every other issue in the case.

Not for how property is divided. What matters far more is the date of separation, since it sets the boundary for what counts as marital.

If it remained identifiable, yes. An inheritance is separate property, but depositing it into a joint account or using it for a jointly titled purchase creates a presumption that it became marital, which tracing must overcome.

They are determined separately. Virginia Code 20-107.3(F) directs the court to decide the property award without regard to support, then consider support afterward. See how alimony is decided.
